USCIS more “Special Rights” for illegal’s…

One of the director’s for the US Citizenship and Immigration Services (USCIS) Friday spelled out the criteria for consideration of deferred action for certain young illegal aliens seeking to remain in the United States under a new initiative at the Department of Homeland Security (DHS).

Beginning Aug. 15, DHS will consider granting exclusion from the threat of deportation from the United States generally to illegal aliens under the age of 31 and with no serious criminal record for periods of two years, which can be renewed indefinitely, said Alexander Mayorkas, USCIS director, in a teleconference Friday.

WOW! When it rains then it pours is the general feeling around these offices today. “Having no clear stipulation of whether or not these individuals are in, applying for, or waiting for the school year to start – this amounts to pure unadulterated amnesty,” remarked William Blake from Annapolis, Maryland.

Illegal aliens who qualified for the Deferred Action for Childhood Arrivals (DACA) process also may seek authorization to work in the United States at the same time they apply for DACA consideration, Mayorkas said. To travel outside of the United States afterward, however, they must receive advance parole from being in the United States illegally. Advance parole only will be granted for humanitarian, educational or employment purposes, he said.

According to Mr. Blake however, who feels that this renewed action – especially DACA – insofar as members within the enforcement community such as Immigration and Customs Enforcement (ICE) appears to not fully understand the specifics of DACA much else anyone outside of the immediate Oval Office or Secretary of Homeland Security’s office.

This is why we refer to this as “Special Rights:” It all falls entirely in the realm of corrupt leadership by the POTUS. The Deferred Action for Childhood Arrivals is the unequivocal unconstitutional, as well as dangerous action taken by President Obama. In June 2012 the president felt he was above Congress, and worse, above the people when he made his decision to establish this DACA by executive order. The legislation has consistently and frequently been voted down by Congress. This has left dreamers without legal U.S. national status and identity. Many of them come face-to-face with this reality as teenagers when they want to get a driver’s license, a Social Security number and a job.

“USCIS will make its determinations on an individualized case-by-case basis,” Mayorkas declared. Now just what is this supposed to mean?

To qualify for DACA consideration, an illegal alien must have been younger than 31 as of June 15, when Homeland Security Secretary Janet Napolitano first unveiled the program. They further must have arrived in the United States before turning 16 years old and have resided continuously in the United States for a five-year period (or greater) beginning on June 15, 2007, until present.

Applicants must have remained physically present in the United States for that entire time but exceptions may be made for brief, “innocent” travel abroad. Applicants must currently be enrolled in school, must have graduated school or must have a general education development (GED) certificate. They also may have been honorably discharged from the armed forces.

This is where we’re sure ICE officers as well as other law enforcement agencies are feeling copious amounts of confusion. In the above paragraph it states that, “Applicants must have remained physically present in the United States…” And as a simple reminder this would be for those individuals who are getting the privileges of the DREAM Act, although it has been defeated time and time again. One, confusion exists over who qualifies for DACA; additionally, quoting Mayorkas from over this is on a case by case basis; something tells us that the entire program is headed for the sewer just as every program officials at the nation’s Capitol in Washington D.C. has turned out.

Now get this latest newsflash:

Mayorkas vowed that any information shared with USCIS about the applicants would not be shared with US Immigration and Customs Enforcement (ICE). However, the agency reserved the right to take legal action against applicants who reveal themselves or their parents or guardians to be national security threats. Moreover, ICE will review the files of those applicants already in the agency’s custody.

Those who qualify for DACA consideration generally fit the description of young illegal aliens who would receive lawful status as a resident of the United States under the Development, Relief and Education for Alien Minors (DREAM) Act, championed by Sen. Dick Durbin (D-Ill.) Republicans in Congress have criticized the Obama administration for bypassing Congress and essentially enacting the DREAM Act by administrative order. And we ask for Senator Dick Durbin, the “champion” to tell We the People how his proposed legislation since that has been resoundly defeated starting in 2000 up until 2011 now becomes law.

Chief among those critics is Rep. Lamar Smith (R-Texas), chairman of the House Judiciary Committee, who renewed Friday his claims that the DACA process is open to fraud and abuse.

“This will lead to a backlog for legal immigrants who followed the rules, while allowing lawbreakers to skip to the front of the line,” Smith said in a statement Friday. “Today’s deferred action guidance is another example of how the president’s policies put the interests of illegal immigrants ahead of the interests of US citizens and legal immigrants. In order to process the millions of applications from illegal immigrants, the Obama administration will have to divert funding and other resources from processing legal immigration applications.
