Freedom of Speech and Lying
The Supreme Court will hear a case regarding the constitutionality of the Stolen Valor Act. Passed by Congress with vast support in 2006, the law makes it a crime to lie about having received military medals. The federal appeals court in California struck down the law citing freedom of speech rights. How do you think the Court will rule in this case?
We don’t believe that anything has happened to our hard wiring in our heads but doesn’t this just seem not only below the bar of acceptable standards but rather like slithering on one’s belly to make an impression? We believe that within the last 2 to 3 years an Admiral connected with the Joint-Chiefs-of-Staff literally killed himself after young kids were gawking over his medals from a magazine cover, and when he checked there was a “V” on a campaign medal indicating valor.
Interesting to me at the time was as most Generals and Admirals have aide-de-camp’s or personal attaché’s that normally set all of the uniforms up for the big brass. But then again there are several of these men who may have the attaché’s but still take responsibility—as an honor – to the uniform and country to do it themselves.
However, this does bring up an escalating problem that must be vetted when someone is appointed to a job, regardless of stature or position. We have discussed here several times the notion of judges who get to the point of legislating from the bench which is precisely what this federal appeals court judge in California has done.
Regardless of the law that apparently was passed overwhelmingly, and given the last case we discussed where the individual (Aaron J. Lawless) was unlawfully wearing one Silver Star, 2 Bronze Stars with attached “V” for valor, and four Purple Hearts in his attempt to gain the title and gift cruise to Hawaii with the firearms manufacturer Glock. Ladies and gentlemen this is the stuff were rubber hits the road. If we have enacted laws that state in essence, “Thou shall not wear, what Thou has not earned…” and then turn around and say some asinine bit about lying is a particular freedom of speech why have a Constitution at all? Essentially and if you know a judge take a copy of this article when you visit – because what they are doing with this type of appeal is exactly the same as “…go ahead and cheat on the exam…or it’s okay to cheat, just don’t get caught.”
I do not believe that the Founder’s had anything remotely close to this whilst submitting the First Amendment.
