What’s the Difference: Your Crap? or My Crap?

Of the first part, mine doesn’t stink…and yours does. And if you must carry on with this rubbish, then I will concede that mine does smell, albeit just like rose pedals on a fresh Spring morning; and yours, well your’s fumes like atomic waste and stinks like Hell itself.

I sometime wonder who will crack first: The ‘Rights Talk’ individuals or the ‘Discrimination Crowd’ or then again, maybe me. Did you know that there is several activists’ groups calling for ‘obesity’ to be handled the same way as a disability?

Did you know that although New Mexico does not allow for same sex marriages, it is nonetheless ‘discriminatory’ not to photograph, officiate, or otherwise NOT be involved with it? Before I go on I just want to mention that when does a person’s Constitutional rights-as guaranteed by the 1st Amendment-stand ad nauseum to the mere wishes of someone else?

Please consider this very, very real event that is occurring now as I type:

ALBUQUERQUE, N.M. – As a Christian, Elaine Huguenin is against efforts to legitimize same-sex “marriage.”

So, when the Albuquerque photographer was asked via e-mail in September 2006 to photograph a “commitment ceremony” for two women, Huguenin declined. That was the end of the matter, she thought. (Where are her rights?)

But Huguenin didn’t take into account New Mexico’s anti-discrimination laws. Instead of hiring another photographer, one of the lesbians, Vanessa Willock, filed a civil complaint against Huguenin’s company, Elane Photography.

Now, in one of the first cases of its kind in the state, a three-member tribunal of New Mexico’s Human Rights Commission is considering the complaint brought forward by New Mexico’s Human Rights Bureau, operated by the Labor Relations Division of the state’s Department of Workforce Solutions. (Too much government, ya think?)

The tribunal will decide whether Huguenin should pay actual and punitive damages to Willock because of her decision not to take pictures of the homosexual ceremony.

I am very surprised at the amount of folks who DID NOT click where it says ‘Please read on’….

Please continue reading here…x:

Assuming the photographer never accepted the offer in the first place, what “cost” was there to the loving couple in her refusal? Shopping for photographers is a regular feature of all wedding arrangements. If one doesn’t work out, you find another. If the couple has to find another photographer cause their first one didn’t work out, then that’s the way it goes. Welcome to the world of wedding, gay folks! I say, no cost to you then no compensation given back to you in a lawsuit.

Maybe photographers should turn it around. Demand compensation from wedding couples who refuse to hire them! At least they can claim to have lost something in the process–the earnings from the job.

I was going to say it makes as much sense as the couple suing the photographer; but actually it almost makes more sense.

I should have gotten into Law. Just chuck your common sense at the door and go for the bucks.

i enjoyed reading this! i am for gay rights myself. i mean “gay” people don’t bother me or anything and in my opinion they have the same rights as everyone else to marry.
and i don’t think that the photographer should be sued. i mean yes she didn’t do the wedding and yes it was because she is against gay rights, but when you are very into your religion and your religion says that same sex marriage is bad you wouldnt want to be put into a situation that would make you feel uncomfortable

but thats just my opinion i guess other people thought it was wrong. =]

i always love your posts! =]

First things first: How are you doing? Damn! I have missed the brain massage I always get when discussing issues with you! Yeah, yeah, I’ve been busier than I want to admit, but that’s still no excuse! Btw, loved the comments!

In the matter of the photographer it has to be the saddest commentary ever for New Mexico; however, at the same time maybe, with the help of the One who can make change, will or otherwise there is probably going to be drastic measures.

With regards to going into law…you had me busting up laughing! So many times I wonder, especially when my friends tell me up front: “Damn, it’s like printing money!” As much as I loathe admitting it, immigration law is perhaps like buying the first offering of Nike or Starbucks! Or…on the other hand sure seems like these ‘Rainbow Types’ are doing okay for themselves.

I can’t thank you enough for the new link! In fact most people with the case have been waiting…get this one: for the appeal date before this tribunal had reached it’s conclusion. This one’s got Supreme Court written all over it which for me, is a sad and disgusting state of affairs for the USA. Do you remember the days when it just stated to the effect: “This is an Equal Opportunity Employer…cannot discriminate upon the basis of race, color, creed, or religion.”?

Lastly for now…I’ve written several pieces on the notion of ‘Tolerance’ inasmuch as America is tolerance exploited and abused. I’ve got to admit that the photographer and husband are getting a special welcome at the Pearly Gates inasmuch as how easy would it have been to go, shoot several rolls of film, and Oops! Accident in the developing room! Those lickers deserved nothing more. CHEERS!
